Thank you for choosing to be a part of the MyZoewell Community and entrusting us with your privacy. Your privacy is important to us and we make efforts to ensure that it is respected.

Accordingly, our Privacy Policy outlines the types of information that we may collect, how it may be used, and ultimately handled when interacting with MyZoewell, our Sites and Services.

Our Privacy Policy applies to the websites located at MyZoewell.com, Store.MyZoewell.com, and all other websites, domains, subdomains, pages, posts, materials, applications, products and services (collectively referenced as, “Sites and Services“) that are owned, operated, managed and or made available by or to MyZoewell, unless otherwise stated.

Information That We May Collect

Depending on how you interact with MyZoewell, we may collect certain categories of information from and about you.

INFORMATION PROVIDED DIRECTLY BY YOU

Personal Information

When you choose to:  contact us, connect with us, register on our sites, place orders, participate in surveys, contests and promotions, submit forms or inquiries, comment on posts, contribute content, provide feedback, or otherwise communicate with us, you may directly provide us with your Personally Identifiable Information (PII).

Personally Identifiable Information (or simply “Personal Information“) is any information that on its own or combined with other relevant information can reasonably be used to identify, contact, or locate you as a person. It may include, but is not limited to the following:

Such as your MyZoewell account email address, username and password as well as your contact information and possibly order information and payment information.

(B)

Contact Information

Such as your name, e-mail address, mailing address, and phone number.

(C)

Order Information

Such as details about your orders from MyZoewell.

(D)

Payment Information

Such as your payment method — depending on which, may entail your name, a portion of your card information (e.g. the last four digits and expiration date) — as well as billing and shipping address.

(E)

Employment Information

Such as your employer, job title, and duties.

Other Information

We classify “other information” as any information other than Personal Information that you may elect to share with us. This may contain:

Content Information

Such as any text, images, audio, and video that you may upload, post, submit or otherwise contribute to or through MyZoewell.

(B)

Feedback Information

Such as your posts, comments, messages, ratings, reviews, recommendations, questions and suggestions to or regarding MyZoewell.

In addition to any Personal Information (and other information) that you choose to provide us, we may also indirectly (and automatically) collect Non-Personally Identifiable Information (NPI) about you through your use of our Sites and Services, the use of cookies and similar technologies.

Non-Personally Identifiable Information (or just “Non-Personal Information“) is any information that, on its own, cannot be used to determine your individual identity. It may include, but is not limited to:

Location Information

Such as your language preferences and geographic location (country, state, and city).

(E)

Demographic Information

Third-Party Information

As part of our operations, MyZoewell may also receive information about you from other sources including our service providers, partners, sponsors, affiliates, and other third-parties (collectively, “Partners and Providers“). This information may entail, for example, payment confirmations, delivery details, and social media engagement and information.

Social Media Information

When you like and follow us on social media networks, engage with us, share our content, and contribute your own, we may receive (or have access to) certain information that you provide these networks. Depending on your privacy settings, this information may include, for example, your username, display name and or page ID, profile picture, age, gender, friend list, location and other information.

How We May Use This Information

Ultimately, our goal in collecting information is to elevate, expand, and enhance your experiences with MyZoewell, our Sites and Services. To accomplish this goal, we may use your information to:

For example, we may use your contact information to respond to you when you contact us, place orders, post comments, provide feedback, submit inquiries, request services and support.

Keep You Informed

We may also use this information to inform you about important news and updates regarding MyZoewell, our Sites and Services as well as special offers, opportunities and events that we think you may find useful.

Fulfill Your Requests

To provide you with the products, services and support that you request from MyZoewell, a combination of your information may be used — including, for example, account, contact, order, payment, employment, content and feedback information. We may also use this information to issue invoices, notices, and confirmations concerning such requests.

The use of your information may also be necessary to administer contests, promotions, polls, surveys, rewards, prizes and other special offers should you elect to participate in them.

MyZoewell maintains multiple avenues to connect and interact with you. These include our Blog and Podcast as well as our social media pages (Facebook, Instagram, Pinterest, TikTok, YouTube, and LinkedIn).

To allow you to participate on these avenues, portions of your personal and non-personal information may be used such as contact, employment, content, feedback, location and demographic information.

Conduct Research and Analysis

To better understand our users and their needs (as a whole) as well as how our Sites and Services are being used, MyZoewell may analyze information about our users including their devices, connections, usage, location and demographics.

Measure Marketing Effectiveness

We may use information that we collect to measure, gauge, and improve the effectiveness and reach of our marketing and advertising communications, campaigns, and initiatives.

Optimize Our Sites and Services

We may also use this information to further develop and optimize our Sites and Services to best fit our users’ needs, interests, demographics and preferences.

To maintain the safety, security and integrity of our Sites and Services, we may use a combination of information. For example, we may use your account information to verify your identity and activity. Similarly, we may use information from and about you to protect against potential spam, fraud, and other violations of our Policies.

Methods We Employ to Protect Information

MyZoewell employs a variety of appropriate methods to protect Personal Information from accidental, unauthorized and unlawful collection, interception, access, use, misuse, alteration, destruction, loss and disclosure. These methods include:

Administrative Protocols

As a privacy precaution, MyZoewell limits access of Personal Information to only those who have a legitimate business need for it, and to the extent necessary to fulfill that need. A “legitimate business need” may be, for example, an employee requiring access to your contact information in order to respond to you when you contact us or submit inquiries. In another instance, it may involve access to your account information to process your orders from MyZoewell.

3.2

User Protocols:

(A)

Children Under 13.  In the interest of protecting the privacy and safety of children while complying with the Children’s Online Privacy Protection Act (COPPA), MyZoewell does not knowingly (nor intentionally) collect, market to, or solicit Personal Information from “Minors” (those under the age of 13) without proper parental or guardian consent. Should we discover that we have inadvertently received such information without proper consent, we will remove that information from our records as quickly as possible.

(B)

California Users.  MyZoewell complies with the California Online Privacy Protection Act (CalOPPA) based on the following:

Our Privacy Policy appears on our homepage via hyperlink, is in capital letters, and is distinguishable from surrounding text. It also contains the word “privacy” as well as:

(1)

The categories of Personal Information that we may collect;

(2)

The categories of third parties with whom we may share this information;

(3)

How Users may modify their information;

(4)

How we respond to “Do Not Track” settings;

(5)

How we communicate changes to our Privacy Policy;

(6)

Our Policy’s effective date (or date last updated) and

(7)

By actually adhering to our stated Privacy Policy.

(C)

European Union Users. We are also committed to complying with the European Union’s General Data Protection Regulation (GDPR) which regulates the privacy and protection of EU citizens’ personal data.

Note:  Under the GDPR, personal data is much broader in scope than Personal Information. As, personal data is considered to be any information that can be used to identify an individual: directly or indirectly.

This means that personal data can include Personal Information (e.g. name and address) as well as Non-Personal Information such as IP address, device id, cookies, and more.

(D)

International Users.  Given that we are a United States (U.S.) based business, but operate in a global environment, your Personal Information may be transferred and stored outside of the country in which it was originally collected, including to the U.S. and any countries where we operate or permit trusted third parties to operate on our behalf. And while we carefully consider where, with whom, and in what manner(s) we do business, the privacy practices and laws of these countries may deviate from our own. As such, our treatment of your information will be in accordance to the terms established in this Policy.

(E)

Third-Party Users.  Because our Sites and Services may include links to third-party websites, applications, products and services — whose privacy policies may differ from our own, we encourage you to review these parties’ policies before sharing any Personal Information with them. As, we have no jurisdiction over other parties’ policies and therefore assume no responsibility for them.

Physical & Technical Protocols

We also maintain a combination of physical and technical protocols to safeguard and secure information.

3.4

Data Retention Protocols

We only retain your information for as long as it’s necessary to fulfill the purpose(s) for which it was collected — as outined in our Privacy Policy, or in the event that a longer retention period is required or permitted by law.

Despite our best efforts, however, no security methods are perfect, fail-proof, or 100% secure. Therefore, we cannot guarantee absolute security of your Personal Information. If at any time, you have reason to believe that your Personal Information may have been compromised while using our Sites and Services, please contact us immediately or submit a privacy inquiry.

With Whom We May Share Information

MyZoewell does not share nor disclose your Personal Information except under limited—and what we deem to be necessary—circumstances as outlined in this Privacy Policy and below.

Providers

To assist us in offering, providing, and improving our Sites and Services, MyZoewell may work with third-party licensors, vendors, service providers and suppliers (collectively, “Providers“) that may result in the disclosure of your Personal Information. Services provided by our Providers may include:

You have choices when it comes to the collection, use, and sharing of your information by both MyZoewell and others. You may choose to exercise these choices by adjusting your preferences concerning communications, cookies, and tracking as well as making modifications to your information.

Communication Choices

If you would like to change your communication preferences — including no longer receiving marketing related communications from us, you may do so at any time by following the opt-out link and or instructions contained in the communications that you have received from us. Please note however, that some communications (non-promotional) — such as administrative, transactional and legal, are still necessary to provide you with our Sites, Services, and important updates, and hence cannot be opted out of.

5.2

Cookie Choices

While some web browsers are set to accept and store cookies by default, you may, if you prefer, instruct your browser to reject or remove them. By rejecting or removing cookies completely however, you may be unable to enjoy certain features of our Sites and Services. 5.3

Tracking Choices

To enable you to convey to websites (and their advertisers) that you prefer not to be tracked across the Internet, most web browsers offer “Do Not Track” (DNT) features. Unfortunately, a proper, uniform and agreed upon standard on how best to respond to these features has yet to be established, adopted or even supported by the web and advertising industry.

MyZoewell’s stance on DNT settings is to honor them to the best of our technological abilities. This currently involves using Google Tag Manager combined with Google Analytics to detect and better respond to them.

Note:  How MyZoewell’s Partners and Providers respond to DNT settings may differ from our own.

5.4

Modification Choices

If at any time, you would like to update, correct, or delete your information, you may do so by logging into your account and making modifications. Changes may also be communicated by submitting a privacy inquiry.

Your Rights Regarding Your Information

Per GDPR, if you are an EU citizen, you also have rights regarding the access, rectification, erasure, restriction, objection and portability of your personal data.

Right of Access

As an EU citizen, you have the right to ask us if we process any of your personal data — and if so, request a free, electronic copy of the following:

(A)

The categories of personal data being processed about you,

(B)

The purposes of the processing,

(C)

The recipients (or categories of recipients) whom the personal data has been or will be disclosed and,

(D)

The length of time that the data will be stored.

6.2

Right to Rectification

You also have the right to request that inaccurate data about you be corrected and incomplete information be completed.

6.3

Right to Erasure

Furthermore, you have the, “right to be forgotten”, or request that your data be erased and no longer processed.

6.4

Right to Restriction

As an alternative to erasure, you also have the right to request that your data be restricted or suppressed if:

(A)

You dispute the accuracy of your data and MyZoewell is in the process of reviewing it;

(B)

Your data was unlawfully processed and rather than having your data erased, you specifically request restriction;

(C)

Your data is no longer needed by MyZoewell, however, you require that it be retained in order to establish, exercise, or defend legal claims and

(D)

You have objected to the processing of your data and MyZoewell is in the process of verifying the grounds for processing.

6.5

Right to Object

In certain circumstances, you even have the right to request that your data cease being processed. These circumstances are:

When the processing is for direct marketing purposes,

(B)

When the processing is for scientific, historical research, or statistical purposes and,

(C)

When the processing is for a public interest task or the legitimate interests of a controller or third party.

Right to Portability

Where technically feasible, you also have the right to have your personal data transported from one organization to another.

Note:  In GDPR terms, processing covers a multitude of operations performed on personal data including collection, structuring, storage, adaptation, alteration, retrieval, use, disclosure and dissemination.

If you would like to exercise your GDPR rights (or any other privacy rights), you may do so by completing a privacy inquiry. Just know that MyZoewell reserves the right to use all reasonable measures to verify your identity before granting you access to any requested data as well as rectifying, erasing, restricting, porting, or ceasing processing it.

Also, while initial requests are free, we reserve the right to charge a reasonable administrative fee for (or refuse to act upon) subsequent, unfounded, or excessive requests. For legitimate requests, you should receive a response within 30 days of receipt. If you do not receive a response after that time (and have a legitimate request), please follow up with us to ensure that we have received your request.

Changes to Our Privacy Policy

As MyZoewell, our Sites and Services, business practices and procedures evolve in addition to privacy-related laws and regulations, technologies, and user expectations, our privacy practices are expected to evolve as well. Accordingly, MyZoewell reserves the right to change this Privacy Policy at any time, for any reason, and to apply any changes to information previously collected, as permitted by law.

Any such changes will be reflected on this page and effective immediately upon posting, unless otherwise stated. If the changes are significant, we may provide more prominent and or advance notice.
